The black hole of personal debt? When married to my ex, who was in the military, I got a Star Card, which is a credit card for the military shops. My husband at the time co-signed. When we were getting divorced, he told me he would pay it off because they wouldn't let him retire until that account had a zero balance. (Not in writing). Well, I'm re-married, and the IRS just took our tax return of $2086.00. They said it was for a past debt, and after researching, I find out it's due to the Military Star Card not being paid off. Now my new husband is mad at me and I am filing an "Injured Spouse" form for him, but he doesn't understand why they would take part of his income tax and not any part of my ex's since he was co-signer. My husband pays his ex about $2000 a month in child support and other "child essentials" and I get no child support. We are sinking into a black hole of debt fast! Any suggestions or financial words that may help? I need some great advice from people! I'm getting extemely stressed and depressed! Yes, I work full time. And although the parenting plan states my ex pays me child support, that was when he was in Iraq. He is home now, for good, and I agreed to shared custody, no support. However, he also had the benefits of using this card, such as a new computer, new TV, etc. It wasn't just me.

help with 8857 tax form? i just did my taxes with turbo tax and we filed a 8857 injured spouse form, after reading it it states "did the IRS use your share of the joint refund to pay any of the following past due debts of your spouse: federal,state taxes , child support, spousal support, or student loans" if yes then stop here and file 8379. well last year they took our whole return of $5,200 and sent it to my child support and my student loans. so what is this 8379 form and how do i go about filing that if i already filed my taxes e-file with 8857 injured worker?
My ex owes Child Support. I have it set up for his income tax refund to be intercepted. Can the IRS take the? Can the IRS take the refund that is due me for back support if I owe the IRS taxes from 2009? I went on the IRS site to check the status of the refund and it actually adjusted the amount by increasing it and states it will be direct deposited this past Friday. It also states the Financial Management Services will be given the money. I am unable to obtain any information from the IRS or CSE. I have no OUTSTANDING DEBT, anywhere that I am aware of. I have methodically observed my CREDIT report and have not defaulted in anything. SO, I am really confused right about now. I owe back taxes of 1500, I am owed 2900 this year. Efiled and accepted, with refund due 10 Feb 2009? Will my refund be delayed or will the IRS computers just take out the money owed and send me my refund as fast as people who owe no money. My dad reckons IRS just deducts the money owed and sends the refund as normal with a letter later to explain the different amount. Can tax expert/ex IRS/person with similar issue in the past please assist me. I know its not a big amount but I just lost my job and the refund will help. According to the automated FMS hot line my debt is not yet listed, (1800 304 3107) is there a chance the money owed wont be deducted this cycle. Does any one know what day the IRS makes the payments. Joint allocation form? Who is the injured spouse...? I am filing my brother's taxes and he needs to file a joint allocation form. He still owes past due child support so he doesn't want to affect his current wife's refund. So on the joint allocation form ( I am using an online tax service) who is considered to be the injured spouse? Would it be him (the one who owes the debt) or her? And another question on this... It list the joint amount of the return for wages, deductions, credits and so on and then has a space for you to enter the amount that should be allocated to the injured spouse. How do you figure this amount out? I don't know what to enter and I have already referred to the IRS's website and can't get a clear answer. ANy help would be appreciated.
What to do when you have fraudulent activity due to someone else filing taxes under your name 5 years ago? My little brother (25) hadn't received a tax return for the past 2 or 3 years. This year, after not receiving his return, he contacted the IRS, and they said that back in 2005, he filed taxes and said he made over $30K that year. He was in College and receiving Financial Aid that year and didn't file taxes claiming that he made that kind of money. Then, apparently 10 years ago when he was 10, he had 2 unpaid credit cards in his name and SSN over $10,000 in debt. But he was 10. Now he's finished college, and he can't get a job anywhere because all the places that are hiring (at least in the state of IL), are running people's credit. Since he's got this fradulent stuff on his credit, he keeps getting turned away after having awesome interviews! He has tried calling the IRS to figure out what to do about this and they're not helping him at all. They say it's not his concern. He tried calling the local police and they said they can't do anything about it. I suggested he call the FBI, but he said they wouldn't do anything. Someone out there in the world is using my brother's SSN to open accounts, file taxes, and who knows what else. What can be done to fix this mess?
What are my options for $25000 in credit card debts? I have about $25000 in unsecured credit card debt spread out over 9 credit cards (BofA, Citi, Mrk, WFG, Chase, Dell, Macys, Target). Why this much? I was dumb and stupid and have no sense of money management but was also married and made some bad business investments. I am now divorced. Majority are now at penalty interest rate!!! OK so I have everything on a payment plan (except WFG that is soon to charge off) but here lies the issue. I have zero savings and my FICO score has already dropped to 475. The home bills (mortgage, utilities & vehicle) takes more than half my monthly income. My biggest concern and fear is that I have my first child coming this December and don't want her to suffer due to Dad's mistakes. My girlfriend has her own financial issue with the IRS for almost same amount as my debt, so I do not get help from her and I can't help her own issues. But I need to start paying the hospital bills from the new baby, and the mom needs come break too. Please advice: 1) Should I cut and run for the next 3-5 years and settle these debts later? Build a savings right now for the baby and her mom too. I am pretty confident I can take care of it later down the line. Maybe save up then start approaching them one by one (in about 12-15 months) and offer lump settlements. 2) Should I file for chapter 13 and get a court's help on repayment; thereby reducing some of the outrageous fees and interest? 3) Should I go for those special payment plans with companies you see on TV? I have seen more negative comments than positive regarding this option Any advice is appreciated and feel free to criticize my past actions. I can only learn going forward. Before I didn't care but now I have this lady and kid, and they both take priority so I feel I should change the situation fast. FYI, I am no longer using them for new purchases. Current salary is $70K which I just started last 2 months, about $4k monthly after taxes. Like I mentioned Mortgage (GF house!) and utilities and transportation is consuming about $3000. My GF is helping as much as she can, but she makes less than half my income and has 1 kid already. My issue is that, regardless of all being on a payment plan except for 1, the debts are not reducing. I feel strongly I need to start saving for medical bills and baby's arrival and do not have the room currently to do so. This is why I am exploring alternative options.
Can creditors (excpet IRS) force you to pay your past due debts if you sell your home? Say I owe 200k to hospitals, credit cards, etc. If I decided to sell my house next month, go to closing and collect the cash to pay off the existing mortgage and keep the remainder in a savings account or someone elses bank account, how can the creditors A) know that you sold the house and have profit and B) once they find out you do have profit, how can they force it out of you if the money isn't even in your own checking or savings account?
penalty for debt write off...never receive notice to report to IRS and not sure if debt is mine.? I have a Creditor that has written off a past due debt. The Creditor has reported to IRS the amt of write off and claims that it is an account of mine. This is 2007 the write off is for 2005 in which the Creditor claims to have sent me something to claim on my Taxes for 2005. I haven't seen anything inregard to claiming any interest on my taxes. I did not recognize said Creditor on IRS letter and I have written a letter to the Creditor with no response and it has been over 30 days now. I've review my Credit Report and did not recognize any such creditor or amt said write off listed on the IRS letter. IRS is stating I owe them 800 dollars due to not reported interest. I have no proof that this account is mines. What can I do?
passport denial due to IRS debt? i am set to go to england in less than two weeks, and i have an appointment in 2 days with a passport bureau to expedite the renewal of my passport. however, i owe $1100 still on my taxes from the past year. i will only be gone for one week. does anyone know positively whether or not the IRS can put a hold on my passport? also, i have not yet set up a payment plan with them.

Am I responsible for paying my new husband's past tax debt? We were married last year and will be filing out taxes together this year. I have a tax refund question.I checked my refund status on the irs website? IRS child support offset question? My sister's husband called the irs offset hotline to find out if his past due child support (about $2500) will be taken out of his rebate. The recording said they had record of an offset and record of a debt. What's the difference? When he pressed the number for the offset information, he was told an offset in the amount of $152 was sent to child support services. The recording instructed him to call the department of child support services for info on the debt. Unfortunately, they haven't been able to get through for days.
Would you hide money from your spouse, if you knew he/she was really horrible at handling money? My husband has got to be the most un-responsible person when it comes to money. I must have been blind to not see this before we married, but somehow I didn't. Over the years that we have been married, he has made alot of really bad financial decisions, and has proven that he can't be responsible with money. I have had to bail us out of more bad situations than I can count, and he always just hangs his head like a scolded puppy and says "Sorry." Given enough time, he'll do something again, and I'll be left to find a way to bail us out of trouble. He has a past due debt against him, so every year I have to file an injured spouse form with the IRS so that I can get my part of the refund. This year they took 1/2 the total refund for his debt and also took 1/2 of that stimulus check too. We had signed up for direct deposit, so it was deposited into my private account.(He has no access to my account due to his past problems.) He was out of work for 2 months recently. He says he was fired, they say he quit, and I can't seem to get the whole truth from anyone involved. But either way, he lost his job and has been out of work for 2 months, meaning I have had to cover all the bills, plus I have had to take care of more of his financial screw ups along with those. I have scrimped and saved money for the past 2 months, and that along with the two IRS refunds, have made my account have a good amount in it. (We aren't rich by any means, but we have enough to get by and to take care of things that we really need.) I haven't told my husband about the money in this account. Since he doesn't have access to it, he had no clue how much is in there. I don't feel I should tell him, because one of us has to be the responsible one, and it obviously won't be him. I'll ask what for and he'll say that he needs gas or a part for his truck or something for the house or lawnmower, and then when I check the receipt I find out that he added 3-4 packs of cigarettes, a Dr Pepper and a snack to it. So basically, if I give him access to this money, he'll not only try to blow it on junk we don't need, he'll also spend more than he tells me he is going to spend. Even though he doesn't have access to my account, he can very easily take my debit card out of my wallet, or he'll hound me and hound me until I give in and let him have some of the money, then that puts us that much further behind on things we need, or that our kids need.

If taxes have been paid from reported 1099-c to the IRS by a consumer, can a business still report the account(s) as a collection/past due on the consumer's credit report? can the IRS come after me if I marry my boyfriend and he owes taxes? My boyfriend and I have been together for three years and he has bad credit and owes the IRS. (this is from a few years ago young and dumb i suppose) Anyway, he owes a couple of years of taxes from prior to us getting together. Stimulus checks stimulate frustration...At least for me? Ok, I just read this in an online newspaper regarding these stimulus checks that most of us are to get. I say "most" as I am a proud owner of a student loan that isn't behind by much, but behind. "Some taxpayers may get a smaller stimulus payment than they expect, the IRS said. If you have a past-due federal or state income tax bill or some other type of past-due federal debt such as student loans or child support, your stimulus payment likely will be reduced by what you owe." I guess I should be relieved that my loan will be paid down somewhat. I would have just blown it on the $400 per month that I pay for gas to drive to work anyway! Anyone else in my boat?
What federal law states that a debt has to be charged off in 180 days? I have been searching on the internet and keep seeing statements like this: "By federal law, financial institutions are required to write off accounts that are more than 180 days, or six months, past due. However certain banks charge off particular loans after the 207th day of non-payment." Can anyone tell me what US Code this falls under?? Or is it a IRS regulation to give the creditor a tax write off. I understand that a debt is a debt until u pay it, just would like to know is it a federal law or not? Chapter 7 Bankruptcy law applies to charging off debt when a company or individual cannot pay. I would like to know when you don't pay a creditor, when do they have to charge if off. Thanks
Will a $5000 deposit to my 2nd chance ckng acct get liened if I owe the IRS? I still owe the IRS over $10k due to admittedly stupid acts by me in the past. And my credit is terrible. I have a '2nd chance' account' with a popular Texas bank that required no credit check to open. I deposit my paycheck there, avg. $450-$550 per weekly deposit. But now, due to an estate settlement, I will soon receive an initial payment of c.$5000 and monthly payments of c.$2000 per month for about 4 years. I am working with a debt counselor re other debts but I am behind to the IRS. What is likely to happen when I deposit the $5000 into my account?
Family business conflict involving the IRS? Our family owns an office building together. I did not pay my taxes due to personal problems for many years. The IRS agent, who said he would give me over a year to resolve the problem myself after I explained that I had a terrible relationship with my family, and that I was unemployed, went ahead and contacted my family about the debt. The family/partnership members have called a partnership meeting for tomorrow, Monday, and I am unable to attend due to some temporary work. I responded to that effect this past Thursday, but the meeting date has not been changed. Is this legal? One of my family members, according to the IRS agent, asked if the business paid off my tax debt, could I then be ousted as a partner. He told them he didn't think so according to the LLC Operating Agreement. My share is worth far more than the tax debt and it was alarming to hear that this family member would try to take my equity away. This same family member mentioned that my share of the office building would be discounted by 40% due to the share being part of a partnership. I spoke to an appraiser who said that the most a building would be discounted was 20 to 25% and that 40% was outrageous. Any advice? Thanks!
Debt collectors harassing and rude ? Hello all , here is my question I received a call from a collection agency Wednesday which kind of shocked me plus she was borderline rude etc no real rude best describes her. She said I have a balance with the VA state tax for tax year 1996 the amount is $1740.00 ok This is the first i became aware of this issue on Wednesday past I had cancer back then was married etc.. So I called the Va tax dept she noted my account and is mailing me info re the debt I am not working now also due to this economy . Then today the collection lady calls me askes if i am going to pay i said i am waiting info and paperwork from the VA DEpt of taxation she said she didnt care and was going ahead to get the money in whatever ways she wishes I do not have property etc and have money in the Bank what can they do ie i heard about it Wednesday she said they are proceeding with collection action Please advise oh the tax return was a joint return for the state not the IRS I also have a credit with the IRS for $3200.00 as i filed an amended return they accepted it so wow but they have not sent me a check just shows i have a credit on my account .. Does anyone have any actual details on the 700B bailout plan? I spent the past several hours trying to research this, and I only get more questions. And I think that if the American public doesn't wake up and pay attention they deserve what is coming down the road! The government is going to spend $700B on purchasing "toxic debt". It was my understanding this was bad mortgages, but others in the banking commission want to include other debts, like loans and credit card debts. Now stay with me.... The "plan" is to then sell these worthless debts, hopefully for a profit. This will bring back the $700B investment. It may take several years. Is it me? Doesn't this sound an awful lot like our government is proposing to become the worlds largest zombie debt collector? Can you imagine having a debt that you THOUGHT was written off, and now the government has control? Do you know how hard it is to get away from a student loan? You can't discharge it in bankruptcy. The government has many avenues to collect that normal collection agencies don't have. So imagine your 6 year old credit card debt that you thought had gone beyond the SOL. Now the government could come after you. Ever hear stories about what the IRS did to force collection on past due taxes? I think we need a lot more answers before we approve this plan. I am baffled- I don't remember ever seeing this message before and I;m worried since my original date of mail out was January 30th and it was pushed to February 6th- I don't have children and I don't owe any money that I know of- Wouldn't FMS tell me if it was offset? I want to speak with a real person- Is this a generic message that everyone receives? I have been married to the same man, the father of my children for 17 years. Checked with my bank and they do show my exact refund as a pending deposit for 2/6. So all is well.

More turbo tax/Stimulus Questions- direct deposit never went thru -owed taxes...so now what?? What happens now. Apparently I was responsible for some past due taxes from my ex- and IRS took my entire refund to pay off those debts, which are now paid in full. So SBBT never really had anything to do with my return. The IRS would have my checking account numbers-yes? No? and i should get my stimulus in my account since technically i never used SBBT- is that correct? Anybody have any idea? I did not end up paying any fees because there was never any funds deposited for them to take from.
Defaulted Student Loan & Income Tax Return? I have a defaulted student loan. According to the IRS website, my income tax refund was mailed on Feb. 8. Today I looked at the refund site and saw this notice: Your refund may be reduced to pay a past due obligation such as child support, another federal agency debt, or state income tax. I called the FMS number to see if there were any debts listed against me, and none were. So, what are the odds that I'm going to get my refund? That is, I don't understand why I suddenly got this notice after my refund was mailed and if none are listed against me on FMS, why did I get the notice at all? Will my tax refund be delayed? I have been paying off a balance with the IRS for the past six years...don't get me started on the reason...apparently I owed $7,000 in taxes when I was 14 years old, now I'm 23, have gone through the OIC application (denied) and have had many unsuccessful arguments with the IRS. I am almost done paying the balance through my installment plan (still clueless as to why I owed the $$). I filed for my taxes on Jan 21, 2009, and found that my refund will pay for the remainder of the taxes owed, and should still leave some money left for me. The "Where's my refund" page on the IRS website states that I will have my refund direct deposited in my account by Feb 3, 2009. Questions: Will my net refund show up later than the Feb 3, due to the offset? When do they process offsets? How does the process work? The IRS website is worthless for exact info. -I talked to a lady at the IRS last night, who confused the HELL out of me. She said that she see's my refund, nothing has been processed, I could get it in as many as 3 weeks, and it could be a PAPER check-but she wasn't sure (what the hell?). I asked her why the IRS quoted Feb.3 as the day for the deposit to show up in my account, and she said that it wasn't a true estimate? Has anyone experienced this situation? Can I wait for her at her job??? or is it Stalking? My wife and I are in the process of getting a divorce, we have been separated for the past 3 years and our communication is almost non-existant. My problem is that my soon to be ex-wife owes an insane amount of money to the IRS ($30,000 due to erroneus deductions), yes we filed jointly and yes, i know we are both liable for this debt. (I was young and stupid for filing jointly, she's a real estate agent and i trusted in her to do them correctly). For the past year I've been trying to get in contact with her but i can't;she always rejects my calls and with all honesty I do not know where she lives but i just recently found out where she works, thats how complete strangers we are. Im trying to get in contact with her so we can set up a payment plan with the IRS,i have recieved a letter saying that they will soon garnish my wages. I tried talking to the IRS and they said I can only set up a payment plan of $500 a month, which clearly I CANNOT afford. Since I've left her voicemails in relation ONLY with the IRS and nothing else.....and I dont get any call backs, can i go wait for her at her job?? Because the IRS is nothing to mess with and obviously its not important to her because she avoids me calls. In the past week and half Ive tried calling her over a hundred times.... I dont want to go the extent of waiting around at her job, but can or should I do that?? She doesnt answer her phone or return my calls I have no other method in getting in contact with her. I talked to the IRS about the situation and they said since she works on commission and I have a steady weekly paycheck they will come after me.... Íts really fustrating because i have limited money..... She in the other hand has a million dollar house,bmw,and benz......I dont know what her problem is or what she is trying to avoid. Another thing, if i were to wait for her at her job i wouldn't make a scene, im a civilized person who has run out of options. passport denial due to IRS debt? i am set to go to england in less than two weeks, and i have an appointment in 2 days with a passport bureau to expedite the renewal of my passport. however, i owe $1100 still on my taxes from the past year but i have a payment plan set up with them. i will only be gone for one week. does anyone know positively whether or not the IRS can put a hold on my passport?
Debt collectors harassing and rude ? Hello all , here is my question I received a call from a collection agency Wednesday which kind of shocked me plus she was borderline rude etc no real rude best describes her. She said I have a balance with the VA state tax for tax year 1996 the amount is $1740.00 ok This is the first i became aware of this issue on Wednesday past I had cancer back then was married etc.. So I called the Va tax dept she noted my account and is mailing me info re the debt I am not working now also due to this economy . Then today the collection lady calls me askes if i am going to pay i said i am waiting info and paperwork from the VA DEpt of taxation she said she didnt care and was going ahead to get the money in whatever ways she wishes I do not have property etc and have money in the Bank what can they do ie i heard about it Wednesday she said they are proceeding with collection action Please advise oh the tax return was a joint return for the state not the IRS I also have a credit with the IRS for $3200.00 as i filed an amended return they accepted it so wow but they have not sent me a check just shows i have a credit on my account .. ANy advice gladly welcome Question is in the next few days will can they go to my bank account and take that money how long does it take for them to and if to do this action.. A few of you asked me re whos making the claim calls etc Its a collection agency "Diversified Collections" I am not get calls from the VA Dept Of Taxation State . The lady from that agency called me this am and she was wow so rude and said they will be proceeding with their action .I expalined I am awaiting paperwork back from the VA State Tax regarding what specifically the debt is for in more details they have noted that i am not working .I do have money but just not working between contracts .Dont i have to receive notification before they can withdraw funds from my account ???
